Terms of Use

The terms that govern your use of the TTG Consulting website and the information you submit through it.

1. About these terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and TTG Consulting Limited, trading as The Transformation Group ("we", "us", "our", "TTG Consulting"), regarding your access to and use of our website at www.ttg-consulting.com (the "Site"), including all content, functionality and services offered through it.

By accessing the Site, browsing its pages, submitting any enquiry form, or otherwise using any part of the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not access or use the Site.

We recommend that you print a copy of these Terms for future reference.

2. Changes to these terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when posted on this page, and the date at the top will be updated accordingly. Material changes may also be notified via a prominent notice on the Site.

Your continued use of the Site following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically.

3. Accessing the site

We do not guarantee that the Site, or any content on it, will always be available or uninterrupted. Access to the Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice.

You are responsible for making all arrangements necessary for you to have access to the Site. You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms and comply with them.

4. Use of the site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site. Prohibited behaviour includes:

  • Using the Site in any way that breaches any applicable local, national or international law or regulation.
  • Transmitting any material that is defamatory, offensive, obscene, abusive, invasive of privacy, or otherwise objectionable.
  • Knowingly submitting false, inaccurate or misleading information through our contact forms, workshop enquiries or any other submission channel.
  • Attempting to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer or database connected to the Site.
  • Introducing or transmitting any viruses, trojans, worms, logic bombs or other malicious or technologically harmful material.
  • Launching denial-of-service attacks or distributed denial-of-service attacks against the Site.
  • Data mining, data harvesting, data extraction or any other similar activity in relation to the Site, or using the Site for any purpose unrelated to the business of TTG Consulting without our express written consent.
  • Using automated systems or software to extract content from the Site for commercial purposes ("screen scraping").

Breach of these provisions may constitute a criminal offence under the Computer Misuse Act 1990 and/or other applicable legislation. We will report any such breach to the relevant law enforcement authorities and co-operate with them. We also reserve the right to take legal action and seek injunctive or other equitable relief.

5. Intellectual property

TTG Consulting is the owner or licensee of all intellectual property rights in the Site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All rights are reserved.

This includes, but is not limited to, text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, frameworks, methodologies, case studies, white papers, and the overall design and "look and feel" of the Site.

You may print off one copy and may download extracts from any page of the Site for your personal reference and to share with colleagues within your organisation, provided you do not modify the paper or digital copies in any way, and you do not use any illustrations, photographs, video or audio sequences or graphics separately from any accompanying text.

You must not:

  • Reproduce, duplicate, copy, sell, resell or exploit any material from the Site for commercial purposes without obtaining a licence to do so from us or our licensors.
  • Modify the paper or digital copies of any materials you have printed off or downloaded.
  • Use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us.
  • Remove any copyright, trade mark or other proprietary notices from copies of materials.

6. Trade marks

"TTG Consulting", "The Transformation Group", our logos, taglines and any other marks indicated as trade marks on the Site are trade marks of TTG Consulting Limited. You are not permitted to use them without our prior written consent. All other trade marks, service marks, logos and trade names that appear on the Site are the property of their respective owners.

7. Information and reliance

The content on the Site is provided for general information and marketing purposes only. It does not constitute professional, legal, financial, technical or other specialist advice. You should not rely on it as a substitute for advice tailored to your specific circumstances.

Formal advice, proposals, statements of work and consulting engagements are only provided under separate written agreements with TTG Consulting, which will set out the specific scope, terms, limitations and responsibilities applicable to those services.

We make reasonable efforts to ensure the information on the Site is accurate and up to date at the time of publication, but we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete, reliable or current. The content may be changed without notice.

8. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Subject to the above, to the fullest extent permitted by law, TTG Consulting and its directors, officers, employees, agents, partners and licensors shall not be liable for any of the following, whether arising in contract, tort (including negligence), breach of statutory duty or otherwise:

  • Any indirect, incidental, special, consequential or punitive loss or damage.
  • Loss of profits, sales, business, revenue, anticipated savings, business opportunity, goodwill or reputation.
  • Loss or corruption of data, information or software.
  • Business interruption or downtime.
  • Any loss or damage arising from your use of, or inability to use, the Site, or from your reliance on any content displayed on the Site.

Our total liability to you for all losses arising out of or relating to these Terms or your use of the Site shall not exceed the amount you have paid us in the 12 months preceding the claim, or £100 (one hundred pounds sterling), whichever is greater.

9. Enquiries and form submissions

When you submit an enquiry via our contact form, workshop form or any other submission mechanism on the Site:

  • You warrant that the information you provide is true, accurate, current and complete.
  • You confirm that you have the authority to provide any company information you submit.
  • You consent to us processing your personal data as described in our Privacy Policy.
  • Submitting an enquiry does not create a contractual relationship, obligation or representation on our part to provide services.
  • We reserve the right to decline any enquiry or engagement at our sole discretion.

10. Third-party links and resources

The Site may contain links to third-party websites, services, resources, social media platforms and content that are not owned or controlled by TTG Consulting. These links are provided for your convenience and information only.

We have no control over the contents, policies or practices of those sites or resources, and we accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply endorsement by TTG Consulting. We recommend that you review the terms and privacy policies of any third-party sites you visit.

11. Viruses and security

We do not guarantee that the Site will be secure or free from bugs, viruses, trojans or other harmful components. You are responsible for configuring your own information technology, software and platform to access the Site, and for using your own virus protection software.

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.

12. Linking to our site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not:

  • Establish a link from any website that is not owned by you.
  • Frame the Site on any other site.
  • Link to any part of the Site other than the home page without our express written permission.

We reserve the right to withdraw linking permission without notice.

13. Governing law and jurisdiction

These Terms, their subject matter and formation, and any non-contractual disputes or claims arising out of or in connection with them, are governed by and construed in accordance with the laws of England and Wales.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Site. Notwithstanding this, we retain the right to bring proceedings against you for breach of these Terms in your country of residence or any other relevant country.

14. Waiver and severability

No waiver by TTG Consulting of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition. Any failure by us to enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

15. Entire agreement

These Terms constitute the entire agreement between you and TTG Consulting regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral.
